Sofern noch keine Dienstleistungen erbracht wurden, kann diese Einwilligung jederzeit widerrufen werden. Wenn bereits Dienstleistungen erbracht wurden werden die Daten lediglich zum Nachweis der korrekten Abwicklung der bisherigen Tätigkeit (z.B.: Dokumentation der Hebammenleistung, Abrechnung der Hebammenleistung) verwendet. Durch den Widerruf der Einwilligung wird die Rechtmäßigkeit der aufgrund der Einwilligung bis zum Widerruf verarbeiteten Daten nicht berührt.
Ihre Daten werden nach Ablauf der gesetzlichen Aufbewahrungspflichten für Dokumentation und Abrechnung (30 Jahre bei Hausgeburten, in allen anderen Fällen 10 Jahren) unwiderruflich gelöscht. Ihre Daten geben wir nicht ohne Ihre Einwilligung weiter - mit Ausnahme gesetzlicher Verpflichtungen wie der Abrechnung.
Ich verarbeite die Daten in Übereinstimmung mit den datenschutzrechtlichen Bestimmungen.
Ihnen stehen grundsätzlich die Rechte auf Auskunft, Berichtigung, Löschung, Einschränkung, Datenübertragbarkeit, Widerruf und Widerspruch zu. 1 General/scope of application
These General Terms and Conditions apply to all contracts for courses and all services provided by midwife Julia Scherzer as a freelance midwife. The scope of the midwife's services (in particular the location, time, duration and aim of the event) is set out in the course description in the version published on the midwife's website at the time of registration.
2. registration
The announcement of an event by the midwife Julia Scherzer, e.g. on my website or on flyers, is non-binding. The announcement of an event is a non-binding invitation to submit a binding offer by the person registering. Registration by the participant takes place online via the registration form on my homepage.
The contract is concluded when a confirmation of registration is sent and the participant is bindingly registered for participation.
3. Payment for antenatal and postnatal courses
The course fees for women with statutory health insurance will be settled directly with the health insurance company, privately insured women will receive an invoice in accordance with the Berlin midwife fee schedule. Missed classes cannot be settled with the health insurance company and must be paid by the participant herself (the amount of the fee can be found in the current midwife remuneration agreement). The partner contribution of €150.00 for couples' birth preparation courses, is not covered by health insurance and must therefore be paid by the participant. Some health insurance companies will reimburse the accompanying person on presentation of a receipt (receipts will be sent by email after payment of the fee). The partner fee must be transferred at least 4 weeks before the start of the course. A confirmation of payment will then be sent.
4. payment for other courses (e.g. baby massage, baby care course, BABYKURS)
The course fee for other courses is not covered by health insurance and is a self-payment service. The fee stated in the course description must be transferred to the specified account.
5 Cancellation
After booking, the course can be canceled in writing or by email up to 4 weeks before the start of the course without incurring any costs. Up to one week before the start of the course, the course can be canceled with a processing fee of 20 euros. If the course is canceled later than one week before the start, the full fee will be charged unless a replacement can be found. It is not possible to replace a participant with another during an ongoing course.
6. reimbursement of costs by private health insurance
Privately insured women will receive an invoice at the end of the course in accordance with the private fee schedule for midwives. Please enquire before the start of the course whether your health insurance covers this midwife service.
Please note: If you do not attend the course, the costs incurred will not be covered by your health insurance.
7 Course participation
Missed lessons are to be paid for by the participant. The reason for not attending the course is irrelevant. The only exception to this is premature childbirth or a serious illness certified by a doctor.
8 Prerequisites for the course
Courses can only take place if the minimum number of participants is reached.
9. change of course leaders and times
The course instructor may postpone classes for urgent reasons. This will be communicated as early as possible.
Consumers are entitled to a right of withdrawal under the following conditions: A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity. The midwife/midwifery practice points out the following to the participant: You have the right to cancel this contract within 14 days without giving reasons. The cancellation period is 14 days from the day the contract is concluded. In order to exercise your right of withdrawal, you must inform the midwife of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or by email). In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period expires.
Consequences of revocation
The midwife/midwifery practice must repay all payments received from the participant immediately, but at the latest within 14 days from the day on which notification of the revocation was received. If the participant has requested that the service begin during the cancellation period, she must pay the midwifery practice an appropriate amount that corresponds to the proportion of the service used up to that point.
